Andy Warhol Foundation Sued by The Velvet Underground
The Art Dossier on January 13, 2012 with 0 CommentsTwo members of The Velvet Underground, Lou Reed and John Cale, filed a lawuist in the U.S. District Court in Manhattan against the Andy Warhol Foundation over licensing issues regarding the iconic banana image created by the artist in 1967.
According to the lawsuit, it claims that the foundation has no copyrights in the design because it is in the public domain and asked that the band be awarded any profits received by the foundation. The foundation has been asked repeatedly to stop licensing the design for use on iPhone and iPad products and the lawsuit is to prevent further sales.
This is not the first time that the album is involved in a legal issue. The original back cover of the album featured an unauthorized image of actor Eric Emerson projected upside-down. MGM was forced to recalled copies of the album until the image could be airbrushed.
